Terms of Service

Effective date: August 7, 2026 · Last updated: August 7, 2026
DRAFT — PENDING LEGAL REVIEW

1. The Service

Driiver provides driver–vehicle identification and electronic vehicle inspection (DVIR) tools for fleets using the Geotab platform. The Service consists of a driver application and an administrative portal ("the Service"), operated by Continuum Partners LLC ("we," "us"), a limited liability company registered in Arizona, United States.

2. Accounts and access

3. Acceptable use

You agree not to misuse the Service, including: attempting to access another driver's or fleet's data; submitting false inspection records; interfering with the Service's operation; or reverse engineering the Service. Do not use the app while driving.

4. Inspections and compliance

The Service transmits inspection records you submit to your fleet's MyGeotab database. Responsibility for regulatory compliance — including the accuracy of inspections, repair certification, and record retention under FMCSA or other applicable regulations — remains with the motor carrier and its personnel. The Service is a recording tool and does not certify vehicle safety.

5. Fleet Customer responsibilities

Fleet Customers are responsible for: obtaining any required consents from their drivers for the processing described in our Privacy Policy; the accuracy of their MyGeotab data; and their compliance with employment and privacy laws applicable to their workforce.

6. Availability and changes

We aim for high availability but the Service is provided "as is" and "as available." We may modify, suspend, or discontinue features with reasonable notice to Fleet Customers.

7. Disclaimers and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, and our aggregate liability arising out of the Service shall not exceed the amounts paid by the applicable Fleet Customer for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, or for vehicle condition, accidents, or regulatory penalties.

8. Governing law

These terms are governed by the laws of the State of Arizona, excluding its conflict-of-laws rules. Venue lies in the state or federal courts located in Maricopa County, Arizona.
